CAR Legal has released a new member benefit: The “Small Claims Court Assistance Manual for REALTORS® and Their Clients: Helpful Hints for How to Make Your Case in Court.”
The purpose of this manual is to help REALTORS® and their clients prepare for and present a case in small claims court. It does not guarantee that one will win a case, but rather, it provides pertinent information that should enable members to make a more knowledgeable and effective presentation.
The manual includes:
- General information applicable to all claims made in small claims court.
- Specific information helpful to real estate related issues.
- Claims by a listing broker for compensation
- Claims by a buyer for return of a deposit or damages
- Claims by a seller for release of a deposit or damages
- Defenses by a broker against claims made by a buyer
Each chapter begins with general information applicable to that category. The subchapters that follow are all organized according to the same format: Sample opening statement, suggested document list, list of relevant forms or clauses, and a list of supporting legal authority for the position being espoused.
The end of the manual contains an Appendix which includes a copy of every legal authority that is mentioned in the manual as well as a copy of every C.A.R. form that is mentioned.
